(Sioux City)– A settlement has been reached in a lawsuit over a deadly boat accident on West Lake Okoboji in August, 2005.
Jill Brosnahan of Perry sued the driver, Justin Nearman, and the owner of the boat, Richard Brandt, in federal court in Sioux City. Her husband, Michael, was killed in the crash.
No details about the settlement were reached.
Nearman, of Sioux Falls, is accused of driving a boat that hit the rear of another boat, killing Michael Brosnahan and injuring his wife. Nearman is accused of being drunk while driving the boat.
He faces three charges–operating a boat while intoxicated resulting in the death of another person, operating a boat while intoxicated resulting in serious injury to another person and failing to offer assistance and aid.
Nearman’s next appearance in Dickinson County District Court is set for February 27th.
