(Des Moines)– The Iowa Court of Appeals has overturned a juvenile court ruling in a child custody case from Dickinson county.
The Juvenile Court ruled the child should be returned to the custody of his parents, who’s full identities weren’t released in the ruling.
The boy and two sisters were removed from their parent’s custody following allegations they had been sexually abused by their father. The Court of Appeals states the mother was not supportive of the girls and claimed that they were lying about their father.
Although the Juvenile Court ruled in favor of the child being returned to the custody of his parents, the Court of Appeals says it’s convinced the child cannot be safely returned to parental custody. In it’s ruling, the court states that there’s abundant evidence that the father has a history of what it describes as “deviant sexual behavior” and sexual misconduct.
The ruling also sites a history of domestic abuse and other issues affecting the couple.
