(Spencer)– The U.S. Attorney’s Office says it has reached a settlement agreement with the Spencer YMCA over an alleged violation of the Americans with Disabilities Act that resulted in the exclusion of a child diagnosed with autism from its programs. U.S. Attorney Sean Berry says the Spencer YMCA cooperated in the investigation and commended them for doing so.
Terms of the agreement call for the organization to adopt a non-discriminatory policy and to institute policies and procedures to evaluate members’ requests for modifications to ensure ADA compliance. The agreement also prohibits staff from using restraints on minors on YMCA premises.
The ADA prohibits discrimination against people with disabilities by public accommodations, including childcare providers and places of recreation.
