(Spirit Lake)– A fall trial date has been set in a case that seeks to remove two people from the Spirit Lake school board.
The case against Beth Will and Ann Goerss is scheduled to go to trial Tuesday, October 14th in Dickinson County District Court.
The trial date was set this (Monday) morning during a scheduling conference.
A petition filed by five people seeks to have the two members removed from the board. They allege open meeting law violations, among others.
Steve Avery, an attorney representing Will and Goerss, has argued in court documents that there are no factual allegations to substantiate the case.
