Motion Filed To Dismiss Case Against Two SL School Board Members

(Spirit Lake)– New developments to report today (Tuesday) in a case that seeks to have two people removed from the Spirit Lake school board.

A motion has been filed on behalf of defendants Beth Will and Ann Goerss that seeks to have the case against them dismissed.

The motion by their attorney, Steve Avery, states that “the statute under which the plaintiffs brought the cause of action requires five residents of the school district to bring the action”. Court documents state that one of the five plaintiffs, Jean Lathrop, was formerly employed by the Spirit Lake School District and that her employment with the district ended as of July 9th, 2008, and that she has since moved to Muscatine, Iowa.

A date for a hearing on the motion, which was filed Monday in Dickinson County District Court, is set for July 28th.
