Dickinson Supervisors Further Review Proposed Easement Ordinance

(Spirit Lake)– The Dickinson County Board of Supervisors again this (Tues.) morning reviewed a proposed easement ordinance. Among other things, it would require the company in charge of a project to pay a $1 million deposit to the county in exchange for crossing any drainage infrastructure. The county would hold that money for five years and use it to repair any damage, with the remainder being refunded to the company. While it’s intended to help address concerns over the proposed construction of two carbon dioxide pipelines in the county, it would also pertain to other utilities, although the county in those cases could reserve the right to adjust or waive the fee altogether.

Assistant County Attorney Steve Goodlow researched and wrote the ordinance. He cited an incident recently in Mississippi involving a hazardous material pipeline…

“And all I could envision when I was looking at those things that are online, what happens if that would happen in Dickinson county and how that would affect tourism, the lake, everything. It would be unbelievably devastating and the million dollars would be a drop in the bucket.”

Supervisor Tim Fairchild added the million dollar up-front fee would fulfill another important purpose…

“Anybody that’s a fly by night operation is going to be scared away. The real doers, the legitimate people, are going to say yeah, no problem, we’ll put it up. When they’re done they’re going to get $980,000 back or whatever they get. I know it’s crazy and I don’t think anybody else has suggested this anywhere in the county or probably in the country but why not? I’ll just put it on you guys to say why not?”

The proposed ordinance will come back to the supervisors at their meeting next week for possible action.
