Dickinson County Supervisors Updated On Revisions Being Proposed To Iowa Drainage Law

(Spirit Lake)– Some changes could be in the offing to Iowa drainage law. Senator Dennis Guth of Klemme introduced some revisions he’s proposing in a bill he introduced last March. The measure is currently still in committee. Don Etler, a former drainage engineer, informed the Dickinson County Board of Supervisors of some of the proposed changes at their meeting earlier this week. Etler says the primary goal is to improve communication with landowners by requiring counties to hold informational meetings prior to engineers conducting studies…

“What we’re looking for is a bill that satisfies the levy district, the big district, the small district and all the counties. The Senator hasn’t met with the IDDA yet.”

Etler says one of the major changes being proposed pertains to bonding requirements…

“The law does change an antiquated law that requires the engineers to post bonds. That hasn’t been done for 50 years or more. I worked 43 years in the business and I never posted bond. It switches the bond requirement to professional liability insurance requirement. The bond on the project though is an improvement, a new lateral in an existing district, that the petitioner would have to post a bond for that.”

Etler says it’s likely the bill won’t advance without support from the Iowa Drainage District Association.
