Court Of Appeals Rules City Not Responsible For Street Dance Incident

(Des Moines)– The Iowa Court of Appeals has upheld a district court ruling that says the city of Sutherland is in no way responsible for an incident at a street dance September 1st, 2003 that injured a man.

Mark Nellis was injured at the dance when a spectator climbed up on the stage and jumped down, landing on Nellis.

Nellis sued the city, accusing it of not using reasonable care to protect him.

A district court ruled in the city’s favor, and Nellis appealed.

In it’s ruling, the Court of Appeals said the city had no control over what the man did.
