(Spencer)– A complaint of a broken down vehicle early Monday in Clay county resulted in two people being arrested on drug charges.
The Sheriff’s Office says it received a report around 12:30 a.m. of an occupied vehicle that appeared to have a flat tire at the intersection of two county roads near Everly. A deputy found the vehicle was unoccupied and a tow truck was requested. A short time later the deputy located 43-year-old Joseph Hofbauer of Coon Rapids walking toward Everly and determined he had been driving the vehicle. The deputy then discovered that Hofbauer was wanted on warrants out of Guthrie county and had a suspended driver’s license. As Hofbauer was being arrested the deputy discovered quantities of methamphetamine and drug paraphernalia. He was taken into custody and transported to the Clay county jail.
As the deputy questioned Hofbauer, it was determined his girlfriend was coming to Spencer to meet him, however a no-contact order was in place between them. The deputy then made contact with Hofbauer’s girlfriend, 30-year-old Talisha Davis of Bayard, at a Spencer motel. A subsequent search of Davis’ vehicle led to the discovery of marijuana and drug paraphernalia. Davis was arrested and taken to the Clay county jail. Hofbauer and Davis’ one-year-old son was in Davis’ car. He was placed in temporary child care until a responsible relative could arrive to take custody of him.
Eventually the vehicle Hofbauer was driving, along with his motel room, were searched, resulting in 11 packages of pseudoephedrine pills and drug parpahernalia being found.
Hofbauer was charged with possession of a controlled substance-methamphetamine; and possession of precursors…both class “D” felonies; and possession of drug paraphernalia…a simple misdemeanor. Bond was set at 19,825-dollars and hold was placed on him for Guthrie county.
Davis was charged with possession of a controlled substance–marijuana…a serious misdemeanor; and possession of drug paraphernalia. Her bond was set at 2,275-dollars.
Clay county authorities also initiated forfeiture proceedings on 540-dollars in cash believed to be involved in illegal narcotics activity.
The investigation continues by the Clay County Sheriff’s Office, the Guthrie and Carroll County Sheriff’s Offices and the Department of Human Services.
