(Des Moines)– The Iowa Court of Appeals has upheld a Dickinson County District Court ruling that allowed the construction of a sanitary sewer line in Maywood.
The Dickinson County Board of Supervisors approved a permit allowing the construction of the line to serve a development owned by Kenneth and Betty Hedrick, doing business as A & B Enterprises.
Adjoining property owners unsuccessfully contested the action in Dickinson county district court. They appealed, alleging the district court erred in its ruling. They contend the streets in the development were never officially dedicated to the public.
The appeals court disagreed, though, saying there’s evidence the streets were indeed dedicated at some time. In their ruling, the justices say the record shows the full length of what was to be Haw Street was at one time actually graded with a typical roadbed and ditches. The ruling states that since Haw Street was dedicated, there’s evidence supporting that was the case with other streets and rights-of-way in the Maywood area.
