Dickinson Co. Supervisors Hear Arguments For & Against Wind Energy Moratorium

(Spirit Lake)– The Dickinson County Board of Supervisors today (Tues.) heard nearly two hours of public comments on a proposal from Invenergy to expand its Red Rock wind farm by constructing additional turbines in eastern Dickinson county. A group called Dickinson County Concerned Citizens again called on county officials to adopt a moratorium on the construction of any new turbines until updates can be made to a zoning ordinance regulating them. However, Kristy Rogers, an attorney representing Invenergy, argued the county’s existing zoning ordinance on wind turbines already addresses the concerns brought up by the group. She also argued that passing a moratorium would be illegal under Iowa law…

“Passing a moratorium is an act in bad faith taking into stock this particular project. Especially when it’s done so for the express purpose of an enacting a new ordinance that will impose new requirements after a project has been developing under for 15 years trying to comply with what you already had in place.”

Jamie Hunter, an attorney representing Dickinson County Concerned Citizens, argued a moratorium would NOT be illegal, saying the supervisors have every right to put one in place….

“You are well within your powers to issue a moratorium. You’re well within your legislative authority and discretion to issue a moratorium. That’s quoting from an Iowa Supreme Court case. Further, moratoriums have been found to play an important role in municipal planning. They aid in bridging the gap between planning and implementation into legal measures. They can be used to preserve the status quo while the study of the area and its needs is completed.”

The supervisors adjourned the meeting following the comments, as action on a moratorium wasn’t included as part of today’s (Tues.) meeting agenda.
