(Spirit Lake)– Dickinson county has successfully defended itself in a lawsuit involving a new R-V park to be constructed at the site of the former Woodlyn Hills Golf Course east of Milford. Megan Kardell, the county’s Zoning Administrator, informed the Board of Supervisors of the judge’s ruling at their meeting this (Tues.) morning. That had Supervisor Chair Bill Leupold asking this question…
“Now that we’re out of this lawsuit, will rules and regs for RV campgrounds be considered?”
Kardell responded by saying it’s something the Planning and Zoning Commission could eventually take up, but she says their top priority right now is updating the county’s comprehensive land use plan…
“I would like to get that finished up first because that is a large undertaking and that kind of seems to be where our focus is at, but we can definitely return to the table for discussions if so directed by you, and so if the Planning and Zoning Commission feels if it needs to be more regulated. The Board of Adjustment does do a good job. I mean if you remember back there were multiple points of stipulations that were put on this campground that they will need to follow. And so I feel the ordinance allows the Board of Adjustment to have that flexibility because just because there’s one RV campground doesn’t mean, a campground is not a one size fits all, and so we don’t want it too constraint that it’s so restrictive but we need enough restrictions but enough flexibility to find that balance.”
A group opposed to the campground filed the legal action against the county claiming procedural errors were made. District Judge Charles Borth ruled otherwise.
