(Spencer)– It wasn’t on the agenda for Monday’s meeting, but the Spencer City Council again discussed the school district’s share of their local option sales tax.
Currently the Spencer School District is receiving a 25 percent share of the revenues from the city’s one cent Local Option Sales Tax. Just last week, voters in Clay county approved a one-cent SILO tax for the school districts in the county.
At Monday’s meeting, councilman Jim Roling brought up the issue of getting the 25 percent back from the Spencer School District because they are now receiving tax revenues of their own.
City Attorney Don Hemphill told the council a special election would be needed to change the wording of the Local Option Tax to divert the 25 percent back to the city. Hemphill added the city could ask the school district to give up the money voluntarily–but that decision could be challenged without an official election.
Councilmen Ed Krebs and Reynold Peterson agreed with the idea of asking the school district to forfeit the money on their own before moving ahead with a special election request.
