Milford Man Sentenced On Theft & Fraud Charges

(Spirit Lake)– A Milford man who pleaded guilty earlier to charges of theft in the first degree…a class “C” felony; and fraudulent practices in the second degree…a class “D” felony…was sentenced Monday in Dickinson County District Court.

Larry Lavin was sentenced to a prison term not to exceed 10 years at the Iowa Medical and Classification Center on the theft in the first degree charge. He was also ordered to pay restitution of more than 265-thousand dollars to his victims.

On the fraudulent practice charge, Lavin was sentenced to a prison term not to exceed five years to be served concurrent with the previous sentence.

Lavin had originally been charged in December of 2004 with four counts of fraudulent practices in the first degree…each a class “C” felony; 14 counts of fraudulent practices in the second degree…each a class “D” felony; and one count of ongoing criminal conduct…a class “B” felony.

The charges stemmed from Lavin selling investments with a Spencer firm. He had been a licensed agent, but on April 8th, 2004 he entered into a consent agreement with the Iowa Insurance Division, which permanently revoked his license for some of the same violations he pleaded guilty to.
