(Spirit Lake)– Attorneys for a Sioux Falls man charged in a deadly hit-and-run boat crash last year in the Iowa Great are requesting his trial be moved out of Dickinson county.
29-year-old Justin Nearman was charged with operating a motorboat while intoxicated resulting in the death of another person, operating a motor boat while intoxicated resulting in the serious injury of another person, and failing to offer assistance and aid.
The august 12th crash on West Lake Okoboji claimed the life of Perry dentist Dr. Michael Brosnahan and seriously injured his wife.
A judge is scheduled to rule on the change of venue request at a March 27th hearing.
Nearman’s lawyers have also filed motions seeking to have the first two counts being tried separately from the charge of failing to offer assistance and aid.
A motion to suppress evidence has also been filed. It seeks to have any evidence gathered prior to the issuance of a search warrant August 19th be withheld from the trial.
Those motions will also be addressed at the March 27th hearing, scheduled for 10:00 a.m. at the Dickinson county courthouse.
