One Area City May Be Tweaking Its ATV/UTV Ordinance

(Estherville)– One area city may be tweaking its ordinance regulating the operation of ATV’s and UTV’s. There was some discussion regarding that at this week’s Estherville City Council meeting when some questions were brought up by a resident. Police Chief Brent Shatto told the council there are some differences between the city’s ordinance and state law. He says one of them is over the age of operation…

“The state law is 18 years of age or older and our city ordinance is 16 years of age or older. So I don’t know the exact answer if we’re required to change that or not.”

Shatto says the city’s current ordinance also prohibits the operation of ATV’s and UTV’s on state highways through Estherville…

“You can only cross Highway 4 and Highway 9 in the city limits. You can’t travel on it. The state law has changed to allow you to travel on a state highway for the necessary distance to get off of it again if you have to again, like crossing the Central Avenue bridge. But our specific city ordinance does not currently allow that. We probably have to look at a change. I don’t know exactly how that works based on the new state law because we have some city ordinances that are contrary, part of our city ordinance is contrary to the new state law.”

City Administrator Penny Clayton said she will meet with Shatto and the City Attorney to review the matter and make any possible revisions that could be considered by the council sometime in the future.
