Spencer City Council Votes Down Ordinance That Would Have Allowed Backyard Chickens

September 08, 2022 Steve Schwaller

(Spencer)– An ordinance that would have allowed residents in Spencer to raise chickens in their backyards failed to pass at a city council meeting earlier this week. It would have included strict limitations on the numbers and other factors that would have gone into consideration for permits to be issued. City councilman Tom Nelson said the vast majority of residents he talked to were against the proposal…

I probably heard from two, three dozen people and there was only two people that were for it. And so while it’s a little disappointing on a personal note, I’m elected by those people and therefore I don’t feel I can go against all of those people that are not in favor of it.”

Nelson added, however, he feels some of the concerns were being blown out of proportion. Councilman Brian Balk said he would like to see the city at least give it a try…

“I truly believe that for the few who wish to see this go through I think it’s reasonable for us to give it an opportunity. A lot of work has gone into it. A lot of different things would be required to even have it go through, but if it’s not meant to be, then what I can tell you is that is this body’s decision and I’ll support it however it goes.”

The council defeated the measure on a 6 to 1 vote with Balk casting the lone vote in favor. The proposed ordinance was up for its second reading at Tuesday’s meeting.
