Motion Seeks To Have Petitions Against Two SL School Bd. Members Thrown Out

(Spirit Lake)– An attorney representing two Spirit Lake school board members is requesting a judge throw out legal petitions calling for their removal from the board.

Steve Avery, an attorney representing the school district on the matter, filed a motion for dismissal Tuesday in Dickinson County District Court.

Among other things, the motion contends the petitions were filed without any factual allegations.

A date for a hearing on the motion hadn’t been set yet.

A date for a hearing on another matter in the case is set for this coming Monday, March 17th. It will determine the amount of bond plaintiffs in the case will be required to put up.

Peter Hart, Palo Alto County Attorney, has been assigned as a special prosecutor in the case.
