Judge Orders Plaintiffs In SL School Bd. Case To Post 90-Thousand Dollar Bond

(Spirit Lake)– Plaintiffs in a case that seeks to have two members of the Spirit Lake school board removed from office will have to post a 90-thousand dollar bond on or before March 26th or the case against Beth Will and Ann Goerss will be dismissed.

That’s the ruling by District Judge Frank Nelson, who held a hearing on the matter this (Monday) afternoon in Dickinson County District Court.

Steve Avery, an attorney representing the two board members, requested a 100-thousand dollar bond, while Peter Hart, a special prosecutor that was appointed to represent the plaintiffs, told the court a 60-thousand dollar bond would be more appropriate.

Iowa law requires private individuals filing actions in district court seeking to remove elected officials from office cover legal fees and court costs.

In addition, Judge Nelson’s order also sets April 7th at 10:00 a.m. as the date and time for a hearing on several motions in the case.
