Judge Grants Continuance Of Trial For SL Man Accused In Fatal Shooting Nearly 1 Year Ago

(Spirit Lake)– A judge has granted a continuation in a trial for a Spirit Lake man accused in a fatal shooting nearly one year ago.

Judge David Lester this (Monday) morning granted the continuation after the defendant, Kenneth Neilson, waived his right to a speedy trial within a year of the incident taking place.

Court documents say Neilson was cleaning a gun in his apartment in downtown Spirit Lake. It discharged after Neilson nearly dropped it. A bullet struck Kenneth Lutterman of Worthington, who was standing on the street below.

Neilson was charged with involuntary manslaughter and discharging a weapon in city limits.

Trial in Neilson’s case, originally scheduled to begin Tuesday (July 22nd) in Dickinson County District Court has now been re-scheduled for December 2nd, 2008.
