(Spirit Lake)– A Dickinson county district court judge has overruled a second motion to dismiss a case that seeks to have the President and Vice President of the Spirit Lake school board removed from office.
Judge John Duffy issued his ruling Monday.
The motion, filed on behalf of defendants Beth Will and Ann Goerss by attorney Steve Avery, sought to have the case thrown out, stating that one of the petitioners that brought the action has moved out of the Spirit Lake school district.
Peter Hart, an attorney representing the plaintiffs, stated in court documents the petitioner still owns a house in the district.
The case is currently scheduled to go to trial October 14th.
