Plea Agreement Reached In Boyd Case

(Spirit Lake)– A plea agreement has been reached in the case of a Milford man accused of criminally transmitting the virus that causes AIDS.

31-year-old Dwayne Boyd had previously pleaded not guilty to four counts of the charge, along with one count of a meth-related charge. He was to go on trial on one of the H-I-V counts as well as the meth charge tomorrow (Tues.) in Dickinson County District Court.

But in a plea agreement announced this (Mon.) afternoon, Boyd pleaded guilty to one count of criminal transmission of H-I-V, in exchange for the other three counts being dismissed. Boyd also pleaded guilty to a charge of possession of a controlled substance, methamphetamine.

Boyd admitted in court this (Mon.) afternoon he had intimate sexual contact with the victim while knowing he was H-I-V positive.

Boyd, who requested immediate sentencing, was sentenced to up to 25 years in prison on the charge of criminal transmission of the H-I-V Virus and was ordered to pay 9,327-dollars in restitution, to be paid to the Crime Victim’s Assistance Program.

Boyd must also register as a sex offender upon being released from prison.

He will be eligible for parole.

On the meth charge, Boyd was sentenced to a year imprisonment, with the term to run consecutively with the H-I-V prison term. The terms will be served at the Iowa Medical and Classification Center at Oakdale.

Two of Boyd’s victims gave emotional statements during this (Mon.) afternoon’s proceedings, stating how their lives have been permanently changed as a result of their contact with Boyd. One victim, who has not yet tested positive for H-I-V, said she’s distanced herself from others out of fear of one day testing positive.

In announcing the sentence, Judge David Lester referred to Boyd’s extensive criminal background, including parole violations.
