(Spirit Lake)– A lawsuit pitting the county against the city of Arnolds Park in a zoning issue has been filed in Dickinson County District Court.
It stems from the county’s action to rezone land on the southeast side of East Lake Okoboji known as the “Nielsen” property for condominiums and an indoor water park. A stipulation in an agreement between the developer and the county prohibits the city of Arnolds Park from ever annexing that area. That didn’t sit well with the city, which filed the suit.
Assistant County Attorney Lonnie Saunders told the board of supervisors Tuesday a copy of the suit has been forwarded to the county’s insurance carrier.
An attorney for the developer says the suit will not hinder construction in any way.
