(Algona)– A motion to dismiss charges against two teens in connection with the January first death of A-J Preston of Ringsted has been overruled.
Delane William Pederson and Nick Symonds, both of Burt, are charged with vehicular homicide and leaving the scene of an accident resulting in a death.
Pederson’s attorney filed a motion to dismiss, last month. This week the motion to dismiss and a motion to supress evidence were overruled.
A hearing is set for June 17th on the amendment to the motion to dismiss. According to court documents, Pederson’s attorney is asking the charges be dismissed as a procedural defect to the Iowa Rules Of Criminal Procedure.
