Duncan Murder Trial Gets Underway

November 22, 2014

(Spencer)– A murder trial is getting under way today (Tuesday) in Clay County District Court in Spencer.

71-year-old Harold Duncan of Spencer is accused of murdering his wife, Karen Kay Duncan, on January 13th, 2003 in their Spencer mobile home.

The trial has been postponed twice previously: once to give the defense more time to prepare for trial; the other postponement was ordered by the judge to rule on Duncan’s competency. He was sent to the Oakdale Medical Classification Center for extensive testing and evaluation.

Duncan’s attorneys have already filed a defense of diminished capacity.

Jury selection is getting underway today (Tuesday) with opening statements expected to start Wednesday.
