Dickinson Co. Supervisors Consider Signing Onto Concrete Class Action Lawsuit

(Spirit Lake)– Dickinson county may become a party in a class action lawsuit against a northwest Iowa Ready Mix Concrete company who’s President has pled guilty in federal court to participating in a felony to fix prices and rig bids.

The Dickinson county board of supervisors Tuesday voted to sign onto the class action lawsuit, which involves a number of other counties and municipalities in the region, contingent on a fee agreement with a Storm Lake attorney that’s representing the entities in the case being worked out.

The attorney, Gene Collins, told the supervisors the county stands to recover a significant amount of money in the case. He says a total of about five million dollars in concrete work countywide, with 1.8 million of that in the secondary roads department and another amount yet to be determined used for the courthouse project, is eligible for litigation.

According to court documents, the price fixing and bid rigging is alleged to have taken place from approximately January, 2008 through August of last year.

The President of the company was charged with violating the Sherman Anti-Trust Act.
