(Spirit Lake)– Dickinson County is deleting a requirement in its subdivision ordinance that has become obsolete. The Board of Supervisors voted 5-0 last week to remove a stipulation that required final plat information be reviewed by the Clerk of Court’s Office to ensure there were no judgements, attachments or leins against the property involved in the process. “There are other certificates in place that they do have to attach to that such as an abstract, an attorney’s opinion, the County Treasurer, the County Engineer if there are public improvements. So there are other mechanisms in place in lieu of the Clerk of Courts, but that’s not something that they do any longer.”
Interim County Attorney Jon Martin told the supervisors the requirement for the review by the Clerk of Court’s Office was included in a state statute that since has been repealed.
