Nearman Hearing Continued

(Spirit Lake)– A hearing has been continued for a South Dakota man charged in a deadly boating accident on West Lake Okoboji last August.

29-year-old Justin Nearman of Sioux Falls is charged with operating a boat while intoxicated resulting in a death, operating a boat while intoxicated resulting in serious injury and failing to offer aid.

The hearing had been scheduled for Monday (March 27th).

Defense motions for a change of venue and separate trials for Nearman on the drunken boating charges and failure to offer aid charge will be continued.

Assistant Dickinson County Attorney Jon Martin says that’s because Nearman’s attorney, Stanley Munger, is scheduled to appear in federal court in an unrelated case.

Nearman has pleaded not guilty in a collision that killed dentist 51-year-old Michael Brosnahan of Perry and injured his wife, Jill.

If convicted, Nearman could face up to 30 years in prison.
