Incident At SL Apartment Leads To Multiple Charges Against E’Ville Man

(Spirit Lake)– Charges have been filed against an Estherville man in connection with an incident earlier this week at a Spirit Lake apartment.

Spirit Lake police say they were called around 1:45 a.m. Monday to an apartment in the 1100 block of 23rd Street in Spirit Lake regarding a man that wouldn’t leave.

The suspect, 26-year-old Christopher Duby, is accused of unlawfully entering the apartment and assaulting two occupants. He was placed into custody. Upon being placed into a police squad car, he kicked out the rear driver’s side window.

Minor injuries were reported to two occupants in the apartment and a police officer, but none sought immediate medical attention.

Duby was booked into the Dickinson county jail on charges of 1st degree burglary…a class “B” felony; 2nd degree criminal mischief…a class “D” felony; interference with official acts…an aggravated misdemeanor; and assault of a police officer…a serious misdemeanor.
