Estherville City Council Again Talks About Possible Revisions To Fireworks Ordinance

May 16, 2023 Steve Schwaller

(Estherville)– There was more discussion at Monday’s Estherville City Council meeting over the city’s fireworks ordinance. A public hearing was held on some possible changes regulating the discharge of fireworks in the city. Councilman Brandon Carlin again expressed his concern over the city’s current ordinance that allows those with city-issued permits to shoot off fireworks. He says those shooting fireworks without a permit are using ignorance as an excuse…

“And how many of them are really honestly going to be called on the carpet and say I knew I was supposed to get a permit but I didn’t. They’re all going to say I didn’t know to get a permit, didn’t know I was supposed to, which again makes the enforcement side of it difficult.”

A motion by councilman Roy Gage to ban all fireworks except display permits failed for lack of a second. That resulted in additional discussion with the city’s Fire Chief, Travis Sheridan. He suggested the city include a requirement that permits be issued only to those who have 1.5 acres of land or more, similar to the city’s ordinance pertaining to open burning of leaves. A motion to include that requirement was approved. Another motion to waive the 2nd and 3rd readings and adopt the provision failed to get the needed number of affirmative votes, meaning it will have to come back to the council for further consideration.
