Entities Sign Agreement To End Water Dispute

November 23, 2014

(Spirit Lake)– All concerned parties have signed off on an agreement to end a territorial dispute between Spirit Lake and Clay Regional Water.

The city, county, Clay Regional Water and Farmer’s Home Administration all signed off on the settlement Tuesday.

Steve Avery, an attorney representing CRW, tells KUOO news the agreement consists mainly of a redrawing of service boundaries.

It also states that the city of Spirit Lake will pay Clay Regional Water five thousand dollars for each of the four customers that are currently served by CRW if the city decides to annex them and provide them service. Clay Regional Water also agrees to provide fire protection at a rate of 750 gallons per minute at 20 pounds per square inch for a two hour duration to any of its service area that’s annexed into the city. The city must provide CRW with any notice to annex within 30 days of any proceedings. It also calls for either entity not to interfere with the other’s lines and easements.
