(Spirit Lake)– A court hearing on a request for a permanent injunction against plans by Dutch Creek Farms to construct a four thousand head hog confinement southwest of Milford has been continued again.
The hearing, postponed twice already, was supposed to be held this coming Monday in Dickinson County District Court.
But documents filed Friday at the Clerk of Courts Office indicate the hearing is being continued to January 21st at 2:00 p.m. There’s no mention as to the reason for the postponement.
Several neighbors living near the proposed operation are listed as plaintiffs in the suit. They site health concerns, potential impacts on property values, and groundwater.
The Dickinson county board of supervisors have appealed a construction permit the Iowa Department of Natural Resources granted for the project. They did so after the D-N-R re-opened a public comment period. The agency took the action after the supervisors failed to notify the public they had received notice Dutch Creek Farms had filed for the permit. It led to the D-N-R issuing a new rule requiring counties to publicize such notices.
