(Spencer)– Charges have been filed against an Everly teen as the result of an alleged incident Wednesday evening in Clay county.
The Sheriff’s Office says a deputy was called around 9:30 pm. to a report of a juvenile passed out in a vehicle, and that beer and drugs may have been involved.
Prior to the deputy arriving, the suspect had fled on foot. He was later found at his parents residence.
Authorities say the suspect became beligerant with his parents and the deputy. He allegedly assaulted his step father as well as the deputy when he tried to take him into custody. The deputy finally subdued the teen by using pepper spray.
The suspect, identified as 17-year-old Michael Shane Grubb, was arrested and charged with assaulting a peace officer, assault, resisting arrest and public intoxication.
Grubb was treated for the pepper spray on the scene by the Everly Fire and Rescue Unit and was later treated at the Spencer Hospital and released.
Grubb was then transported to the Youth Emergency Services Center in Cherokee where he’s being held pending a future hearing in Clay County District Court.
Authorities say charges are pending against other minors that may have been drinking with Grubb.
