(Des Moines)– The Iowa Supreme Court has tossed out the sentence of a man convicted of luring women to a Spirit Lake factory in 2001 where he tied them up and photographed them.
In Wednesday’s ruling, the high court says a lower court judge improperly allowed victim impact testimony about similar crimes Robert Matheson committed in another state.
The court says such testimony can only be included for crimes committed in Iowa and sent the case back for resentencing.
Matheson pleaded guilty to two counts of second-degree burglary and three counts of false imprisonment. He got ten years on the burglary counts and one year on each of the false imprisonment charges.
