(Milford)– Meeting in special session Friday, the Milford city council approved the form of contract for the Lower Gar project…with what City Attorney David Stein, Junior says are three page of supplementary conditions to protect both the city and the county…and better defines the exact scope of the project.
And because the county is funding the project, Stein said the city should not sign any contractor documents, saying those should be strictly between the county and contractor.
The supplementary conditions also specify that in no way is the city to be held liable for any injuries, property damage, and so on.
The council voted four to nothing to approve the form of contract. Councilman Keith Feller was absent.
The changes now must be reviewed by Assistant County Attorney Lonnie Saunders to make sure their palatable to the county. Supervisor Chairman David Gottsche said he expects Saunders will review the documents and have a report back to the supervisors at their meeting this coming Tuesday. If the county has any concerns, they could be discussed with city officials at Tuesday’s Milford city council meeting. The issue is listed as a tentative item on the council’s agenda for that evening.
Time is of the essence for the Lower Gar project, which county officials want to get done yet this fall so the improved structure would be in place for any high water event next spring.
