Spirit Lake Man Sentenced On Federal Firearms Charge

(Sioux City)– A Spirit Lake man has been sentenced to a year and-a-half in prison on a federal firearms charge. 36-year-old Andrew Mitchell pleaded guilty October 25th of last year to prohibited person in possession of a firearm.

As part of a plea deal, Mitchell admitted that on August 8th, 2023, he was stopped by law enforcement for riding his bike on the wrong side of the road in Spencer, and that he provided a false name to the officer. Mitchell resisted being handcuffed and was arrested. During a search of Mitchell, police located a suspected THC vape pen, methamphetamine, drug paraphernalia, a scale with methamphetamine residue and a loaded 9 millimeter gun with an obliterated serial number strapped to his chest.

Mitchell admitted to being a user of controlled substances which prohibited him from possessing firearms. Mitchell is being held in the custody of a federal marshal pending transport to a federal prison.

The case was investigated by the Spencer Police Department, the Clay County Sheriff’s Office and the Bureau of Alcohol, Tobacco, Firearms and Explosives.
