(Spencer)—A Spencer man charged in the death of another man during an altercation outside a bar in downtown Spencer has been sentenced in Clay County District Court.
23-year-old Chase Foote had originally pleaded not guilty to a charge of second degree murder in connection with the death of Jefferson Wilbur. Wilbur was severely injured in the altercation and died of his injuries in November of 2012 at a Sioux Falls hospital. Foote, in a plea deal, changed his plea to guilty in exchange for the lesser charge of involuntary manslaughter and misdemeanor charges of assault with intent to cause bodily injury and public intoxication…second offense.
Foote was sentenced Monday to five years in jail on the involuntary manslaughter charge and a year each on the assault and public intoxication charges. The sentences are to be served consecutively.
Foote has since been transported to the Oakdale Classification and Medical Center.
