Rental Property, Fish House Ruling Discussed At Okoboji Council Meeting

November 22, 2014

(Okoboji)– It was standing room only again at Tuesday’s Okoboji city council meeting with discussion centered on a rental property near Okoboji Boats and a recent supreme court ruling pertaining to the “Fish House”.

The first item dealt with what’s known as the “Crawford House” near Okoboji Boat Works. Neighbors had recently raised questions about whether the rental property was in violation of a city ordinance. The question stems from a sign on the residence stating “rooms for rent”. City officials responded by saying the property is not in violation as long as it is not rented to more than five different individuals, and that units had to be rented for atleast 30 days. The neighbors were told they have the right to file nuisance complaints with police, or after visiting with the land lord about their concerns, to pursue litigation at their own expense.

There was also discussion over the recent Supreme Court ruling pertaining to the “Fish House”. In essence the ruling states the “Fish House” can be moored at the boatworks, but liquor cannot be served until it leaves the dock. City officials say it is still classified as an excursion boat as long as alcohol is not served on it. They added they’re waiting to see what the outcome is of an injunction the city has filed over the matter in district court.

The council also discussed going into closed session to consider possible future litigation but opted not to do so.
