North Dakota Ruling Could Derail Carbon Pipeline Project

(Bottineau, ND) — A carbon dioxide pipeline project impacting Iowa could be derailed by a ruling from a North Dakota judge.

The judge ruled in favor of landowners who challenged a state law requiring residents to allow carbon dioxide to be stored beneath their property if 60 percent of their fellow landowners approve it. Summit Carbon Solutions acquired a permit for the project and received approval from 92 percent of landowners in the area last year, but the judge this week ruled the law is unconstitutional.

The pipeline project has dozens of proposed capture sites in Iowa, as well as four other Midwestern states.

Lawyers for Summit and the North Dakota attorney general are expected to appeal the case to the state Supreme Court.
