(Spencer)– The suspect in a Spencer beating case has now been charged with first degree murder, after the victim passed away this weekend.
Spencer Police and the Clay County Attorney’s Office announced Sunday 21-year-old Christopher Fitzpatrick has now been additionally charged with murder in the 1st degree.
Authorities say the murder charge was filed after the victim in the August 28th beating, 59-year-old Edward Kitto, passed away Saturday (9/8) afternoon at a Sioux Falls hospital after never having regained consciousness.
Murder in the 1st degree is a class “A” felony.
Fitzpatrick was already being held in the Clay county jail on other charges in connection with the incident.
Kitto was found beaten and unresponsive in the backyard of a residence in the 500 block of East 3rd Street in Spencer.
