(Des Moines)– The Iowa Supreme Court has reinstated a $10 million award to a businessman who claimed a casino and its owner backed out of an agreement to let him manage the facility.
Friday’s opinion overturns a 2009 appeals court ruling that threw out the award for Signature Management Group President John Pavone.
In 2006, Pavone sued Wild Rose Entertainment, which owns casinos in Emmetsburg and Clinton. He claimed Wild Rose violated a contract for him to manage its soon-to-be built casino in Emmetsburg.
Wild Rose owner Gerald “Gary” Kirke argued he never entered into a contract to hire Pavone. His lawyers said the contract was merely “an agreement to agree” on a future management contract.
Polk county jurors ruled in Pavone’s favor in September 2007.
