(Spirit Lake)– A judge has revoked the probation of a man who pled guilty in connection with a fatal boat crash in August of 2005 on West Lake Okoboji.
Justin Nearman was operating a boat that collided with another one, claiming the life of 51-year-old Michael Brosnahan of Perry. Authorities said Nearman was intoxicated at the time of the crash.
He was sentenced to five years in prison and was placed on probation for another five years. Nearman was released from prison in April of 2009.
Terms of his probation called on Nearman to obey all state and federal laws and city ordinances. He was also banned from operating a vehicle without a license or insurance and was ordered not to use alcohol or any drugs that weren’t prescribed.
An arrest warrant was issued for Nearman after he was stopped for speeding in Minnehaha county, South Dakota in November of 2010. Officers said they could smell alcohol on his breath. His blood alcohol content was measured at .09…above the .08 legal limit. Nearman pled guilty in March to second-offense driving under the influence.
At a hearing on Monday in Dickinson County District Court, Judge John Duffy revoked Nearman’s probation, sending him back to prison.
