(Spirit Lake)– A judge this (Mon.) morning heard arguments in the case of a former school bus driver for the Okoboji Community School District accused of sexually abusing a student. Steven Titterington of Milford was charged with sexual abuse in the 3rd degree, sexual abuse by a school employee and child endangerment.
During today’s (Mon.) hearing, Chris Sandy, an attorney representing Tittertington, told a judge mental health records of the alleged victim should be allowed as evidence in the case, as well as those of a rebuttal witness who could possibly be called by the state. He argued that without them, his client wouldn’t get a fair trial.
Andrew Prosser, who’s representing the state along with Dickinson County Attorney Amy Zenor, argued otherwise, saying mental health and school records should be kept confidential and that there’s no discovery with rebuttal witnesses in the state of Iowa. Pamela Wingert, an attorney representing the alleged victim in the case, joined the state’s argument.
Judge Carl Petersen said he would take the matter under advisement and issue a ruling in coming days.
A jury trial was to start July 5th, but it was revealed during today’s (Mon.) proceedings that will be pushed back to a new date to be determined.
