Dickinson County Supervisors Again Talk About Possible Dissolution Of A Drainage District

December 20, 2023 Steve Schwaller

(Spirit Lake)– There was more discussion at Tuesday’s Dickinson County Board of Supervisors meeting over the possible dissolution of Drainage District 50, which is on the north side of Milford. Landowners in branch 33 of that district were assessed large amounts of money for a project in that area several years ago that wound up being scrapped after costs started coming in much higher than expected.

A drainage engineer for the county told the supervisors Tuesday the final decision on doing away with the district lies with the landowners. He says they would need to file a petition with over half of those owning at least 60 percent of the land in the district being in favor of dissolution. He added that all outstanding debts and assessments would need to be paid off as well before any dissolution could occur.

It was also pointed out that traditional drainage laws would still be in place, even if the drainage district was to go away. In that instance, they say neighboring landowners and possibly the courts would need to intervene in drainage-related matters.

The supervisors Tuesday encouraged landowners interested in dissolving the district to get a petition started.
