(Spirit Lake)– Meeting in a rare Monday session, the Dickinson County Board of Supervisors this morning approved both the preliminary and final plats for the Egralharve Club Subdivision on the west side of West Lake Okoboji. It consists of five lots on 10 ares of land between 168th Street and North Inner Lane. A stipulation says the five lots cannot be subdivided.
Developer Chad Baker told the supervisors some highly restrictive covenants will be included to help protect the integrity of the area. Under Iowa law, those covenants would be allowed to expire after 20 years unless they’re renewed. Supervisor Tim Fairchild expressed some concern over that…
“I mean normally the change to the landscaping is not this aggressive and good. It looks, I approve of all of this, I think it’s a great idea. But I am concerned that in the future someone could certainly go ahead and change things considerably.”
Don Hemphill, an attorney for Baker, said that’s a fact of Iowa law and is out of their hands. He added the covenants are worded as strongly as legally possible, adding that a 90 percent vote would be required for any revisions.
