Dickinson Supervisors Hear Update On Des Moines Water Works Lawsuit

(Spirit Lake)-- The Dickinson county board of supervisors Tuesday heard an update on a lawsuit Des Moines Waterworks has filed against Buena Vista, Calhoun and Sac counties. Waterworks is suing the three counties, saying they should be held accountable for high levels of nitrates and other pollutants flowing through tiles in drainage districts.
John Torbert of the Iowa Drainage District Association told the Dickinson County Board of Supervisors most of the attention for now has shifted to the Iowa Supreme Court. He says that’s due to a judge’s ruling following a hearing in December on a motion to have atleast one part of the case thrown out...
Torbert expects action by the Supreme Court will some relatively quickly, based on tight timeframes that have been set for motions and other issues. Trial for the case itself is set for August of this year, but could be delayed if the supreme court findings aren’t in by then.
