Administrative Law Judge Upholds Action By Spencer City Council To Deny Renewal Of Southside Bar & Grill Liquor License

(Des Moines)-- An administrative law judge has upheld action taken by the Spencer City Council to deny the renewal of a liquor license for Chris Burg, owner of Southside Bar and Grill, an adult entertainment business in Spencer.

The city council voted in June against the renewal citing evidence that underage customers had been served in the establishment and that performers violated regulations pertaining to indecent exposure.

A worker at the establishment was cited after serving alcohol to an underage person who drove a vehicle after leaving the business that crashed, resulting in the deaths of 19-year-old Alfonso Maldonado of Graettinger and 21-year-old Tephante Smith of Estherville.

The ruling by the Administrative Law judge reads: “based upon the clear violations of Iowa Code Section 728.5 and the clear and repeated violations of Iowa Code Section 123.47, the local authority did not abuse its discretion under the statute and rules and was justified in concluding that the licensee lacks the requisite good moral character to hold a liquor license.”
